Punishment: 1st DUI in 10 years

40 hours of community service
Driver's license suspension – 12 months (a limited drivers permit may be available)
Alcohol and drug counseling
Mandatory drug and alcohol treatment program

Punishment: 2nd DUI in 10 years

The number of convictions are measured by date of arrest – not date of conviction. The criminal penalties are measured by the number of convictions within 10 years.
A 2nd conviction of DUI within 10 years may subject a driver to the following:
Maximum Fine of $1,000.00
Up to 12 months in jail (72 hours minimum required to be served)
Up to 12 months of probation
240 hours (30 days) of community service
Driver's license suspension – 12 month minimum with requirement of Ignition interlock device
DUI Court programs (not available or required in all jurisdictions)
Red stripe on license
Drug and Alcohol treatment program
Publication of photo in the local newspaper- if 2nd conviction in 5 years ($25 publication fee required).
License plate surrender – if 2nd conviction in 5 years.
