Punishment: 1st DUI in 10 years

  • Alcohol and drug counseling
  • Mandatory drug and alcohol treatment program
  • DUI school
  • Victim Impact Panel (not required in all jurisdictions)

Punishment: 2nd DUI in 10 years

The number of convictions are measured by date of arrest – not date of conviction. The criminal penalties are measured by the number of convictions within 10 years.

  • A 2nd conviction of DUI within 10 years may subject a driver to the following:
  • Maximum Fine of $1,000.00
  • Up to 12 months in jail (72 hours minimum required to be served)
  • Up to 12 months of probation
  • 240 hours (30 days) of community service
  • Driver’s license suspension – 12 month minimum with requirement of Ignition interlock device
  • DUI Court programs (not available or required in all jurisdictions)
  • Red stripe on license
  • Drug and Alcohol treatment program
  • Publication of photo in the local newspaper- if 2nd conviction in 5 years ($25 publication fee required).
  • License plate surrender – if 2nd conviction in 5 years.
