If you are convicted of a DUI in Georgia the punishment, penalties, and consequences you face will depend on the number of DUI convictions on your record within a specified time period. The number of convictions are measured by date of arrest – not date of conviction. The Drivers License penalties are measured by number of convictions within 5 years.

1st DUI Conviction in 5 years:

– 12 Month Suspension.

– Limited Driving Permit Available.

– Eligible for restoration of full license after 120 days of successfully using temporary driving permit with no violations.

2nd DUI Conviction in 5 years:

– 18 – 36 month Suspension.

– No Limited Permit available initially.

– After 120 days, eligible for a limited driving permit with an Interlock Device after meeting conditions.

To become eligible for the limited permit:

– 120 with no additional violations.

– Certificate of eligibility from a drug court program (at Judge’s discretion) or

Proof of enrollment in substance abuse treatment and completed clinical evaluation.

– The limited permit requires the use of an Interlock Device for a minimum of eight months.

– While you are required to operate an Interlock Device in your vehicle before a restoration of your license, a Judge may grant a waiver of this requirement (but not the time of suspension) in certain circumstances.

3rd DUI Conviction in 5 years.

– A 3rd Conviction of DUI within 5 years will result in being deemed a habitual violator and a license suspension of up to 5 years.
