Marietta Municipal Court hears select misdemeanor charges where the arrest has been made by Marietta Police Department including traffic violations. These citations include all minor traffic citations such as speeding or failure to maintain lane up through charges for Driving under the influence, shoplifting (less than $500), minor in possession, Possession of Marijuana and parking and zoning citations issued by Marietta Police Department.
The maximum punishment for any offense heard in Marietta Municipal court up to 12 months in jail and a fine up to $1000.00 plus surcharges (which can almost double the base fine). There are many offenses that can cause license consequences including a suspension. These offenses include but are not limited to - DUI, Hit and Run, Child Endangerment, any offense for which 4 points are assessed for those under the age of 21.

Court is held in Marietta every Wednesday and Thursday with times rotating between a morning and afternoon session. Individuals that are represented by an attorney are taken first, then those without attorneys are taken in the order they arrive. There is usually only one prosecutor, so arriving late can cause significant delays.

Marietta Pre-Trial Diversion Program:
The Pre-Trial diversion program in Marietta Municipal Court is designed to give first time offenders and second chance. If the individual successfully completes the program, there charges will be dismissed and restricted from their record.
Marietta Municipal allows for those charged with the following offenses to apply for the program:

Possession of Marijuana

Minor in Possession

Theft by Shoplifting (under $500)

Generally, the program is approximately 3.5 months and you are required to appear monthly with your pre-trial diversion coordinator. In certain circumstances, the court may allow you to be supervised by your attorney and complete the program prior to your scheduled court date.
