Punishment: 3rd DUI in 10 years

If you are convicted of a DUI in Georgia the punishment, penalties, and consequences you face will depend on the number of DUI convictions on your record within a specified time period. The number of convictions are measured by the date of arrest – not the date of conviction. The criminal penalties are measured by the number of convictions within 10 years.

A 3rd conviction of DUI within 10 years may subject a driver to the following:

  • Maximum fine of $5,000.00
  • Up to 12 months in jail (15 days minimum are required to be served)
  • Up to 36 months of probation
  • 240 hours (30 days) of community service
  • 5-year driver’s license suspension
  • DUI Court programs (not available or required in all jurisdictions)
  • Mandatory drug or alcohol treatment program
  • Publication of photo in the local newspaper – upon 3rd conviction in 5 years ($25 publication fee)
